CALOOCAN City Rep. Edgar ‘Egay’ Erice has filed a bill which seeks to amend a provision under the National Internal Revenue Code or more popularly known as the Tax Reform Act of 1997 by raising the age requirement for ‘tax-exempted’ dependents of an individual taxpayer.
The good congressman from the city’s 2nd District, in his House Bill No. 5559 entitled: “An act amending Section 35 (B), Chapter 7 of R.A. 8424, otherwise known as the ‘National Internal Revenue Code of the Philippines,’” moves to raise the age bracket for ‘exempted’ dependents from 21 to 22 -23 years-old who are either ‘unmarried, not gainfully employed or are incapable of self-support because of mental or physical defect.’
Based on the current set-up under the same revenue code, an exemption of P8,000 is allowed for each dependent not exceeding four.
A stalwart of the ruling Liberal Party being its political affairs chair, Rep. Erice says the exemption for a dependent shall be claimed by only one of the spouses in the case of married individuals.
In the case of legally separated spouses, the exemptions may be claimed only by the spouse who has custody of the child or children, the Erice bill says.
“Provided that the total amount of additional exemptions that may be claimed by both shall not exceed the maximum additional exemptions herein allowed,” the Caloocan lawmaker explains.
In the same Erice measure, the age of a dependent which means ‘a legitimate, illegitimate or legally adopted child chiefly dependent upon and living with the taxpayer’ shall be raised from 21 to 22-23-years old.
Asked why he comes out with the idea of raising the age requirement for dependents, Cong. Erice, who has been in public service since he was with the Kabataang Barangay before he became a member of the House of Representatives in 2001 then a city councilor and vice mayor, says he’s just after the well-being of ordinary and hardworking taxpayers.
“It’s just the right time to think of the interest of the lowly taxpaying people who deserve such support from the government,” he says.
Setting aside, he’s cautioned some widows and kin of the ‘Fallen SAF 44’ from being exploited by the ‘real enemies of peace and democracy.’
“Several interest groups are exploiting the grief and devastation of SAF 44 widows and relatives to sow intrigue, fanning the flames of discontent and promoting their vested interest at the expense of the widows and relatives.”
Rep. Erice then takes the opportunity to cite the distinct heroism shown by the 44 SAF troopers “who gave their lives for their country and for their particular mission of neutralizing Marwan.”
“No one can deny that kind of heroism,” said Rep. Erice as he lambasts the leftist groups that are ‘condoling’ with the SAF widows yet their comrades in the countryside are continuously killing the fellow PNP officers and soldiers. GOOD RIDDANCE/ARLIE CALALO
